Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and AskTarot ("AskTarot," "we," "our", or the "Operator") governing your access to and use of the AskTarot website, mobile-responsive web app, and all related features (collectively, the "Service"). AskTarot is operated by an independent developer rather than a registered corporation; the Operator's full name and address are available on request via the email in §17. By creating an account, clicking "I agree," or using the Service in any way, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

We may revise these Terms at any time by posting an updated version with a new "Last Updated" date. Material changes take effect seven (7) days after we notify you by email or in-product banner. Your continued use after the effective date constitutes acceptance. Older versions are available on request at itrunswap@gmail.com.

Age

You must be at least eighteen (18) years old to create an account, purchase a subscription, or receive paid readings. Users aged thirteen (13) through seventeen (17) may view free, non-personalized content — such as card meaning pages and educational articles — only with verifiable parental or guardian consent. We do not knowingly permit anyone under thirteen (13) to use the Service (or under sixteen (16) where the GDPR allows EEA member states to set a higher age).

By using AskTarot you represent that you meet these requirements and that you have the legal capacity to enter into a binding contract. We reserve the right to verify age and to suspend or terminate accounts that misrepresent age.

Excluded jurisdictions

AskTarot is not offered to users located in, or accessing the Service from, any of the following jurisdictions: the Russian Federation, the Crimea / Donetsk / Luhansk regions of Ukraine, Cuba, Iran, the Democratic People's Republic of Korea (North Korea), and Syria, together with any other country, territory, or person subject to comprehensive sanctions administered by the United States Office of Foreign Assets Control (OFAC), the European Union, or the United Kingdom. This list is required to comply with our upstream AI providers' acceptable-use policies, which prohibit serving users in sanctioned jurisdictions.

By using AskTarot you represent that you are not located in, ordinarily resident in, or accessing the Service from, any excluded jurisdiction, and that you are not a person or entity to whom services may not lawfully be provided under applicable sanctions or export-control laws. We may block or terminate access based on indicators such as IP address, payment country, or your own statements; we have no obligation to provide the Service in any jurisdiction.

To access most features you must register an account using a valid email address. You agree to provide accurate, current information and to keep your credentials confidential. You are solely responsible for all activity occurring under your account. Notify us immediately at itrunswap@gmail.com if you suspect unauthorized access. AskTarot will never ask for your password by email.

You may not transfer your account, share login credentials, or create accounts using automated means. We may refuse registration, reclaim usernames, or suspend accounts at our discretion.

AskTarot offers AI-generated tarot card readings, written card interpretations, spread layouts, and related content.

AskTarot is provided strictly for entertainment, self-reflection, and personal-insight purposes only.

Tarot readings on AskTarot are produced by artificial intelligence models supplied by third-party AI providers — currently Anthropic, PBC (Claude) and OpenAI, OpCo, LLC (GPT), and from time to time additional AI model providers we may engage. They reflect symbolic interpretations of randomly drawn cards combined with your written question. Readings are not factual predictions, professional advice, or statements of truth. They are not a substitute for advice from a licensed physician, mental-health professional, attorney, accountant, financial advisor, or any other qualified expert.

AskTarot, the Operator, and our AI providers do not claim, and do not represent, that we, our software, or our AI models possess any occult, supernatural, psychic, paranormal, mystical, or divinatory powers. Readings are generated by statistical language models that produce plausible-sounding text in response to prompts; they are not channeled, divined, or otherwise obtained from any non-physical source. We do not "pretend to tell fortunes" or claim to influence, contact, or affect any spirit, force, or future event.

If you are in crisis, contact a local emergency service or a qualified professional. You agree that any decision, action, or inaction you take based on a reading is solely your own responsibility, and AskTarot, its operators, and its AI providers shall bear no liability for any consequences.

You acknowledge and agree that readings on AskTarot are generated by large-language-model AI systems, not by human psychics, mediums, or licensed practitioners. AI output can occasionally contain inaccuracies, contradictions, or unexpected content. AskTarot does not warrant the accuracy, completeness, or fitness for any particular purpose of any AI output. We do not guarantee uniqueness: two users asking similar questions may receive similar readings. You may not represent AI-generated readings on AskTarot as the work of a human reader.

Some features of the Service require a paid subscription processed by Creem.io, our third-party billing provider. By starting a subscription you authorize AskTarot and Creem.io to charge your payment method the applicable plan fee plus any taxes.

Subscriptions automatically renew at the end of each billing cycle (monthly or annually) at the then-current rate unless you cancel at least 24 hours before renewal. You can cancel at any time in Account → Billing; cancellation takes effect at the end of the current paid period and you retain access until then.

Refunds

We offer a 7-day refund window for first-time subscribers who have used fewer than three (3) paid readings. Outside this window, all charges are non-refundable, except where mandatory consumer-protection law requires otherwise. EU and UK consumers have a statutory 14-day withdrawal right; by purchasing and immediately using a reading, you expressly request immediate performance and acknowledge that the right of withdrawal is lost once the reading is delivered.

To request a refund, email itrunswap@gmail.com before initiating a chargeback; chargebacks initiated without first contacting us may result in account suspension.

Price changes

We may change subscription prices with at least 30 days' advance notice. New prices apply at your next renewal; you may cancel before renewal to avoid the change.

Your content

You retain ownership of the questions and personal context you submit ("User Input"). By submitting User Input you grant AskTarot a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, transmit, and process the User Input solely to deliver the Service to you. This license ends when you delete the User Input or your account, except to the extent we have already transmitted the input to AI providers for processing (in which case their retention policies apply, as described in our Privacy Policy).

AI output

AI-generated readings ("AI Output") are produced by third-party models and licensed to you under a non-exclusive, non-transferable, revocable license for personal, non-commercial use. You may copy and share your own readings for personal purposes. You may not resell AI Output, republish it commercially, use it to train any AI system, or claim it as your own original work. AskTarot does not claim ownership of AI Output and does not warrant that it is unique. Pursuant to our agreements with Anthropic and OpenAI, your User Input is not used to train their models.

AskTarot content

All other content on the Service — our logo, name, written card descriptions, spread layouts, code, design, illustrations, and curated content — is owned by AskTarot or licensed to us and protected by intellectual-property laws. You receive no license to such content beyond what is necessary to use the Service as intended.

You agree not to:

• ·Use the Service in violation of any law or regulation
• ·Submit content that is hateful, harassing, threatening, defamatory, sexually explicit involving minors, or that incites self-harm or violence
• ·Attempt to reverse-engineer, decompile, scrape, or systematically extract content from the Service, including card descriptions, reading templates, AI outputs, or images
• ·Use AskTarot to generate content for resale, for training another AI system, or for any commercial divination service
• ·Impersonate any person or misrepresent your affiliation
• ·Interfere with the Service's operation, including circumventing rate limits, paywalls, authentication, or security measures
• ·Submit deliberately adversarial inputs designed to elicit harmful, illegal, or policy-violating AI output ("prompt injection," "jailbreaking")
• ·Use the Service to make decisions concerning medical, legal, financial, or emergency matters
• ·Share your account credentials or allow another person to use your account

Violations may result in immediate suspension or termination without refund and, where applicable, referral to law enforcement.

The AskTarot name, logo, and visual identity are trademarks of AskTarot. The Service's source code, design, copy, and curated content are protected by copyright. Card artwork displayed on AskTarot includes original commissioned illustrations, modified derivatives of the public-domain Rider-Waite-Smith deck, and licensed third-party works; you may not extract or reproduce them outside the Service.

We respect intellectual-property rights and will respond to valid notices of infringement under the DMCA and equivalent laws; send notices to itrunswap@gmail.com with the required information (identification of the work, infringing material, your contact details, good-faith statement, and signature).

The Service relies on third-party providers including Supabase (database), Vercel (hosting), Creem.io (payments), Anthropic and OpenAI (AI models), and others identified in our Privacy Policy. We are not responsible for the acts, omissions, or terms of these providers, and your relationship with them (where applicable, e.g., payment terms with Creem.io) is governed by their own agreements. Outages, errors, or changes by these providers may affect the Service; we will make commercially reasonable efforts to maintain availability but do not guarantee uninterrupted service.

By you

You may stop using the Service and delete your account at any time via Account → Settings. Deletion is permanent; reading history is removed from active systems within 30 days as described in our Privacy Policy.

By us

We may suspend or terminate your account, with or without notice, if you violate these Terms, if we suspect fraud or abuse, if extended inactivity (24+ months) makes account upkeep impractical, or if we discontinue the Service. We will provide at least 30 days' notice and a prorated refund of unused prepaid time if we discontinue the Service for business reasons. Sections 4, 5, 7, 8, 9, 11, 12, 13, 14, and 15 survive termination.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT READINGS ARE TRUE, ACCURATE, RELIABLE, OR FREE OF ERRORS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES; IN THOSE JURISDICTIONS, OUR WARRANTIES ARE LIMITED TO THE MINIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASKTAROT, ITS OPERATORS, EMPLOYEES, CONTRACTORS, AND AI PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST DATA, EMOTIONAL DISTRESS, OR DAMAGES ARISING FROM DECISIONS MADE IN RELIANCE ON A READING, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID ASKTAROT IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (ii) USD $50.

Some jurisdictions do not permit such limitations; in those, our liability is limited to the smallest amount permitted by applicable law. Nothing in these Terms excludes liability for death, personal injury caused by negligence, or fraud, where such exclusion is prohibited by law.

You agree to indemnify and hold harmless AskTarot, its affiliates, and its and their officers, employees, and contractors from any claim, demand, loss, or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your User Input, (c) your violation of any law, or (d) your infringement of any third-party right. We reserve the right to assume the exclusive defense of any matter subject to indemnification; in that case you agree to cooperate.

These Terms, and any dispute, claim, or controversy arising out of or relating to them or to the Service, are governed by the laws of the Hong Kong SAR, without regard to its conflict-of-laws principles. Subject to the next paragraph, you and AskTarot agree that the courts of the Hong Kong Special Administrative Region shall have exclusive jurisdiction to settle any such dispute, claim, or controversy, and that any judgment of those courts may be enforced in any court of competent jurisdiction.

Nothing in this section deprives a consumer of the protection afforded to them by mandatory provisions of the law of the country where they have their habitual residence. In particular, consumers in the European Union, the European Economic Area, the United Kingdom, and Switzerland retain the right to bring proceedings in, and to benefit from the consumer-protection law of, their country of habitual residence, and may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

To the maximum extent permitted by applicable law, you and AskTarot each waive any right to participate in a class action, class arbitration, or other representative proceeding. Either party may bring an individual action in small-claims court or equivalent, and either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property.

Before filing any claim, you agree to first contact us in good faith at itrunswap@gmail.com and give us thirty (30) days to attempt to resolve the matter informally.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and AskTarot. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor. Notices to you may be sent by email; notices to us must be sent to itrunswap@gmail.com.
